These terms are the agreement between you, a person or business running a shop on Stallkeep, and Design Studio Lab Ltd (company number 11222280), 2 Damara Way, Ashford TN25 7FD, which runs Stallkeep. By opening a shop or using it, you agree to them.
The service
Stallkeep gives you a back office for your products, stock, purchasing, orders, invoices and accounts, an online shop, and connections to services such as payment providers, couriers and marketplaces. We keep improving it, so features may change; we won't remove something you rely on without telling you first.
Your account
- Keep your sign-in details safe and use two-step sign-in. You're responsible for what happens under your account and your staff's accounts.
- Give us accurate details and keep them up to date.
- Tell us straight away if you think someone else has got into your account.
Your shop and your sales
- Your sales are between you and your customers. You're responsible for your products, prices, descriptions, delivery, returns and refunds, and for following the law that applies to your shop, including consumer, product safety, data protection and tax law.
- Payments go to your own Stripe or PayPal account under your agreement with them. Stallkeep doesn't hold your customers' money.
- You must not use Stallkeep to sell anything illegal, to mislead people, to send spam, or to post fake reviews.
- For your customers' personal information, you are the controller and we are your processor. Our privacy notice explains how we handle it.
Goods you can't sell on Stallkeep
You are the seller of everything in your shop, and you're responsible for your listings. You must not list:
- Knives and weapons. Knives and offensive weapons can't be sold online on Stallkeep yet: the law needs an age and photo ID check on delivery, which Stallkeep doesn't offer yet (Offensive Weapons Act 2019). Some weapons can't be sold at all.
- Drugs and drug kit. Controlled drugs, psychoactive substances and the kit for taking them can't be sold (Misuse of Drugs Act 1971, Psychoactive Substances Act 2016).
- Tobacco, vapes and nicotine. Tobacco, vapes and nicotine products are for over-18s only, and Stallkeep has no age check at checkout yet.
- Prescription medicines. Prescription and pharmacy medicines can only be sold by a registered pharmacy (Human Medicines Regulations 2012).
- Counterfeit and replica goods. Fakes and replicas of branded goods are illegal to sell (Trade Marks Act 1994).
- Live animals. Selling pets and live animals needs a council licence, and Stallkeep doesn't support it.
- Fireworks. Fireworks are for over-18s only and need a licence to sell outside the permitted seasons (Fireworks Regulations 2004).
- Insurance and financial products. Insurance can only be sold by a firm authorised by the FCA, and Stallkeep doesn't sell regulated products.
- Anything else that is illegal to sell in the UK, or to sell to the person buying it.
Stallkeep checks listings automatically for these goods. A listing that matches is saved as a draft until we've looked at it; we don't delete it. We may hide a listing, or pause a shop's online store, when we believe it breaks these terms or the law, and we'll tell you why in your back office and by email.
Connections to other services
When you connect a service such as Stripe, PayPal, a courier, Etsy, eBay or Google, your use of it is also covered by that service's own terms. We can't control those services, and they may change or stop what they offer.
AI tools
AI tools suggest text and pictures. Check what they produce before you use it: you're responsible for what goes on your shop and what you send to customers. AI tools never publish or send anything by themselves.
Fees
Prices for plans, add-ons and AI credits are shown in your shop before you buy. Paid plans renew until you cancel them; you can cancel at any time and keep what you've paid for until the end of the period.
Your content and data
What you put into Stallkeep stays yours. You give us permission to store and use it only as needed to run the service for you. You can export your products and records, and close your shop, at any time.
Suspending or closing a shop
We may pause a shop that breaks these terms or the law, or that puts other shops or customers at risk. Where we can, we'll tell you first and give you a chance to put it right.
Responsibility
We work hard to keep Stallkeep running and your data safe, but we can't promise it will never be interrupted. We aren't responsible for losses we couldn't reasonably have foreseen, or for business losses such as lost profit. Nothing in these terms limits responsibility that the law doesn't allow to be limited, such as for death or personal injury caused by negligence, or for fraud.
Changes and the law
If we change these terms in a way that matters, we'll email shop owners before the change takes effect. These terms are governed by the law of England and Wales. Questions: [email protected].
